Article R23-112-8 of the French Labour Code

In the event of a tie between two or more organisations after application of article R. 23-112-7, the seat is awarded to the professional employers’ organisation with the largest number of member companies in the professional and territorial area of competence of the committee.

In the event of a tie after application of the previous paragraph, the seat is awarded to the professional employers’ organization with the largest number of member companies at national level in the committee’s professional area of competence.

En cas d’égalité entre deux ou plusieurs organisations après application de l’article R. 23-112-7, le siège est attribué à l’organisation professionnelle d’employeurs qui a recueilli le plus grand nombre d’entreprises adhérentes dans le champ de compétence professionnel et territorial de la commission.

En cas d’égalité après application de l’alinéa précédent, le siège est attribué à l’organisation professionnelle d’employeurs qui a recueilli le plus grand nombre d’entreprises adhérentes au niveau national dans le champ de compétence professionnel de la commission.
