Article R23-113-1 of the French Labour Code

For the application of the second paragraph of Article L. 23-114-1, an employee who benefits from delegation hours on behalf of one or more employees of the committee shall inform his employer of the number of hours available to him in this respect and of the identity of the employee or employees who grant him these hours. An employee who allows one or more employees on the committee to benefit from his or her delegation hours shall inform his or her employer of the number of hours and the identity of the employee or employees benefiting from these hours. In both cases, the information provided for under this heading is made by any means that gives it a certain date.

Pour l’application du deuxième alinéa de l’article L. 23-114-1, le salarié qui bénéficie d’heures de délégation de la part d’un ou de salariés de la commission informe son employeur du nombre d’heures dont il dispose à ce titre et de l’identité du ou des salariés qui le font bénéficier de cette ou de ces heures. Le salarié qui fait bénéficier de ses heures de délégation un ou plusieurs salariés de la commission informe son employeur de ce nombre d’heures et de l’identité du ou des salariés qui en bénéficient. Dans les deux cas, l’information prévue à ce titre est faite par tout moyen lui conférant date certaine.
