Article R23-113-3 of the French Labour Code

I. – Notwithstanding the provisions of articles R. 3252-2 to R. 3252-5, where the trade union organisation has not reimbursed the employer for all or part of the sums due within the period provided for in the last paragraph of article R. 23-113-2, the employer may deduct from the employee’s salary, within the limits provided for in I of article R. 2145-7.

II. – The employer shall inform the employee of the deduction at least thirty days before making the deduction or making the first deduction.

III. – The employer may not make the deduction if his request was sent after the deadline mentioned in the first paragraph of article R. 23-113-2.

Article R23-113-3

I. – Par dérogation aux dispositions des articles R. 3252-2 à R. 3252-5, lorsque l’organisation syndicale n’a pas remboursé l’employeur de tout ou partie des sommes dues dans le délai prévu au dernier alinéa de l’article R. 23-113-2, l’employeur peut procéder à une retenue sur le salaire du salarié, dans les limites prévues au I de l’article R. 2145-7.

II. – L’employeur informe le salarié de la retenue au moins trente jours avant d’y procéder ou de procéder à la première retenue.

III. – L’employeur ne peut procéder à la retenue lorsque sa demande a été transmise hors le délai mentionné au premier alinéa de l’article R. 23-113-2.
