Article R2311-1 of the French General Code of Local Authorities

I. – The decree provided for in the second paragraph of Article L. 2311-1, which divides the municipal budget into chapters and articles, is adopted on the report of the Minister responsible for local authorities and the Minister responsible for the budget. It defines the chapters and articles taking into account the provisions of II below.

II. – 1° For municipalities that vote their budget by nature, the functional presentation provided for in the first and second paragraphs of article L. 2312-3 is carried out, for communes of 3,500 inhabitants or more, at the level of the function and, for communes of 10,000 inhabitants or more, at the finest level of the nomenclature by function.

For the budget, the functional presentation thus defined is cross-referenced with each of the budget chapters or items according to the level of vote chosen by the municipal council.

For the administrative account, this functional presentation is cross-referenced with each of the budget items.

If the municipal council so decides, the budget documents of a municipality with fewer than 3,500 inhabitants may include a functional presentation that complies with the above provisions.

2°In communes of 10,000 inhabitants or more voting their budget by function, the presentation provided for in the first paragraph of Article L. 2312-3 is made at the finest level of the nomenclature by function for individualised operations and services.

For the budget, the presentation thus defined is cross-referenced with the two-digit accounts by nature.

For the administrative account, this presentation is cross-referenced with the most detailed account opened in the nomenclature by nature.

3° The functional cross-referenced presentation provided for in Article L. 2312-3 is not applicable to a single-activity communal public service set up as a public establishment or the subject of an annexed budget.

Article R2311-1

I. – Le décret prévu au second alinéa de l’article L. 2311-1 qui divise le budget de la commune en chapitres et articles est pris sur le rapport du ministre chargé des collectivités locales et du ministre chargé du budget. Il définit les chapitres et articles compte tenu des dispositions du II ci-après.

II. – 1° Pour les communes votant leur budget par nature, la présentation fonctionnelle prévue au premier et au deuxième alinéas de l’article L. 2312-3 s’effectue, pour les communes de 3 500 habitants et plus, au niveau de la fonction et, pour les communes de 10 000 habitants et plus, au niveau le plus fin de la nomenclature par fonction.

Pour le budget, la présentation fonctionnelle ainsi définie est croisée avec chacun des chapitres ou articles budgétaires selon le niveau de vote retenu par le conseil municipal.

Pour le compte administratif, cette présentation fonctionnelle est croisée avec chacun des articles budgétaires.

Si le conseil municipal en décide ainsi, les documents budgétaires d’une commune de moins de 3 500 habitants peuvent comporter une présentation fonctionnelle conforme aux dispositions ci-dessus.

2° Dans les communes de 10 000 habitants et plus votant leur budget par fonction, la présentation prévue au premier alinéa de l’article L. 2312-3 s’effectue au niveau le plus fin de la nomenclature par fonction pour les opérations et les services individualisés.

Pour le budget, la présentation ainsi définie est croisée avec les comptes par nature à deux chiffres.

Pour le compte administratif, cette présentation est croisée avec le compte le plus détaillé ouvert dans la nomenclature par nature.

3° La présentation fonctionnelle croisée prévue à l’article L. 2312-3 n’est pas applicable à un service public communal à activité unique érigé en établissement public ou faisant l’objet d’un budget annexe.
