Article R2312-12 of the French Labour Code

In the absence of an agreement as provided for in article L. 2312-21, the database is made available to the persons mentioned in the last paragraph of article L. 2312-36 on a computer medium for undertakings with at least three hundred employees, and on a computer medium or on paper for undertakings with less than three hundred employees.

The employer informs these persons of the updating of the database in accordance with procedures that it determines and sets the procedures for accessing, consulting and using the database.

These arrangements enable the persons mentioned in the last paragraph of article L. 2312-36 to usefully exercise their respective competences.

En l’absence d’accord prévu à l’article L. 2312-21, la base de données est tenue à la disposition des personnes mentionnées au dernier alinéa de l’article L. 2312-36 sur un support informatique pour les entreprises d’au moins trois cents salariés, et sur un support informatique ou papier pour les entreprises de moins de trois cents salariés.

L’employeur informe ces personnes de l’actualisation de la base de données selon des modalités qu’il détermine et fixe les modalités d’accès, de consultation et d’utilisation de la base.

Ces modalités permettent aux personnes mentionnées au dernier alinéa de l’article L. 2312-36 d’exercer utilement leurs compétences respectives.
