Article R2312-36 of the French Labour Code

The Social and Economic Committee is responsible for the management of social and cultural activities which do not have a legal personality, with the exception of apprenticeship and vocational training centres.

Irrespective of how they are financed, this management is carried out:

1° Either by the Social and Economic Committee;

2° Or by a special committee of the Committee;

3° Or by persons appointed by the Committee;

4° Or by bodies set up by the Committee and which have received a delegation.

These persons or bodies act within the limits of the powers delegated to them and are accountable to the Committee.

Article R2312-36

Le comité social et économique assure la gestion des activités sociales et culturelles qui n’ont pas de personnalité civile, à l’exception des centres d’apprentissage et de formation professionnelle.

Quel que soit leur mode de financement, cette gestion est assurée :

1° Soit par le comité social et économique ;

2° Soit par une commission spéciale du comité ;

3° Soit par des personnes désignées par le comité ;

4° Soit par des organismes créés par le comité et ayant reçu une délégation.

Ces personnes ou organismes agissent dans la limite des attributions qui leur ont été déléguées et sont responsables devant le comité.
