I.-For the consultations mentioned in article R. 2312-5, in the absence of an agreement, the social and economic committee is deemed to have been consulted and to have given a negative opinion on expiry of a period of one month from the date provided for in this article.
If an expert is called in, the period referred to in the first paragraph is extended to two months.
This period is extended to three months in the event of one or more expert reports being used in the context of consultations taking place both at the level of the central social and economic committee and at the level of one or more establishment social and economic committees.
II – When it is necessary to consult both the central social and economic committee and one or more works councils in application of the second paragraph of article L. 2316-22, the deadlines provided for in I apply to the central social and economic committee. In this case, the opinion of each works council is given and sent to the central social and economic committee no later than seven days before the date on which the latter is deemed to have been consulted and to have given a negative opinion in application of I. Failing this, the opinion of the works council is deemed to be negative.
