Article R232-74 of the French Sports Code

The Agency acknowledges receipt of the application for authorisation under the conditions set out in articles R. 112-4 and R. 112-5 of the Code des relations entre le public et l’administration. This acknowledgement of receipt starts the twenty-one clear day period within which the Agency must notify the sportsperson of its decision. If the Agency does not respond to an application for a Therapeutic Use Exemption within this period, it will be deemed to have rejected the application. Where applicable, the person(s) with parental authority or the legal representative of the person concerned are informed in the same way.

When the French Anti-Doping Agency receives an application for a Therapeutic Use Exemption from a person who has declared himself to be an “international level athlete” in the form provided for in 1° of article D. 232-73, it informs him that this application must be sent to the International Federation to which he belongs.

L’agence accuse réception de la demande d’autorisation dans les conditions prévues par les articles R. 112-4 et R. 112-5 du code des relations entre le public et l’administration. Cet accusé de réception fait courir le délai de vingt et un jours francs dans lequel l’agence notifie sa décision au sportif. Le silence gardé par l’agence au-delà de ce délai sur une demande d’autorisation d’usage à des fins thérapeutiques vaut décision de rejet. Le cas échéant, la ou les personnes investies de l’autorité parentale ou le représentant légal de l’intéressé sont informés selon les mêmes modalités.

Lorsque l’Agence française de lutte contre le dopage est destinataire d’une demande d’autorisation d’usage à des fins thérapeutiques d’une personne s’étant déclarée ” sportif de niveau international ” dans le formulaire prévu au 1° de l’article D. 232-73, elle l’informe que cette demande doit être adressée à la fédération internationale dont elle relève.
