Article R232-85-3 of the French Sports Code

The purpose of the processing mentioned in Article R. 232-85-2 is to :

1° Gathering information on athletes within the meaning of Article L. 230-3 who have been or are holders of a Therapeutic Use Exemption;

2° Promoting the mutual recognition of exemptions issued, in their area of competence, by the authorities mentioned in the first paragraph of Article R. 232-85-2;

3° To avoid the initiation of criminal and disciplinary proceedings against an athlete who holds a valid authorisation;

4° To facilitate the exercise by the World Anti-Doping Agency of its prerogatives with regard to therapeutic use authorisations.

Article R232-85-3

Le traitement mentionné à l’article R. 232-85-2 a pour finalités de :

1° Rassembler des informations sur les sportifs au sens de l’article L. 230-3 qui ont été ou sont titulaires d’une autorisation d’usage à des fins thérapeutiques ;

2° Favoriser la reconnaissance mutuelle des autorisations délivrées, dans leur domaine de compétence, par les autorités mentionnées au premier alinéa de l’article R. 232-85-2 ;

3° Eviter l’engagement d’une procédure pénale et disciplinaire à l’encontre d’un sportif titulaire d’une autorisation en cours de validité ;

4° Faciliter l’exercice par l’Agence mondiale antidopage de ses prérogatives en matière d’autorisation à usage thérapeutique.
