Article R2322-1 of the French Public procurement code

The purchaser may award a contract without prior advertising or competitive tendering if only irregular tenders, as defined in article L. 2152-2, or only unacceptable tenders, as defined in article L. 2152-3, have been submitted. In such cases, the initial terms of the contract may not be substantially altered and the purchaser must only allow the tenderer or tenderers who have submitted tenders that comply with the requirements relating to the formal deadlines and procedures for submission to take part in the negotiations.

L’acheteur peut passer un marché sans publicité ni mise en concurrence préalables lorsque, soit seules des offres irrégulières définies à l’article L. 2152-2, soit seules des offres inacceptables définies à l’article L. 2152-3 ont été présentées. Les conditions initiales du marché ne peuvent alors être substantiellement modifiées et l’acheteur ne doit faire participer à la négociation que le ou les soumissionnaires qui ont présenté des offres conformes aux exigences relatives aux délais et modalités formelles de présentation.
