Article R2322-2 of the French Public Health Code

Without prejudice to the provisions of Book I of Part VI of this Code, any natural or legal person intending to undertake or continue the operation of a health care establishment referred to in Article L. 2322-1, whether or not they are responsible for its medical management, must submit an application to the Director General of the Regional Health Agency for the region in which the establishment operates or will operate, with a view to obtaining the authorisation provided for in that Article.

This application must be accompanied by a file containing, in particular, all relevant information on the natural or legal person submitting the application, as well as on the person responsible for the medical management of the establishment in cases where this management is not provided by the operator.

Sans préjudice des dispositions du livre Ier de la partie VI du présent code, toute personne physique ou morale qui se propose d’entreprendre ou de poursuivre l’exploitation d’un établissement de santé mentionné à l’article L. 2322-1, qu’elle en assure ou non la direction médicale, doit adresser au directeur général de l’agence régionale de santé de la région dans laquelle fonctionne ou fonctionnera l’établissement, une demande tendant à obtenir l’autorisation prévue à cet article.

Cette demande doit être accompagnée d’un dossier contenant notamment tous renseignements utiles sur la personne physique ou morale qui la présente ainsi que sur la personne chargée de la direction médicale de l’établissement dans les cas où cette direction n’est pas assurée par l’exploitant.
