Article R2333-123 of the French General Code of Local Authorities

Where the fee provided for in a public service delegation agreement corresponds, on the one hand, to the occupation of the public domain and, on the other hand, to the financing of works handed over to the municipality on expiry of the agreement or to the municipality’s contribution to the costs of establishing works, the part due for the occupation of the public domain is established separately on the occasion of the first revision of the agreement.

Lorsque la redevance prévue dans une convention de délégation de service public correspond, d’une part, à l’occupation du domaine public et, d’autre part, au financement d’ouvrages remis à la commune à l’expiration de la convention ou à la participation de la commune aux dépenses d’établissement d’ouvrages, la partie due pour l’occupation du domaine public est établie distinctement à l’occasion de la première révision de la convention.
