Article R2334-10 of the French General Code of Local Authorities

I.-Proceeds from traffic fines are shared, in proportion to the number of traffic offences committed in their respective territories during the year preceding that for which the allocation is made, between:

1° Public establishments for inter-municipal cooperation with their own tax status with a population of at least 10,000, to which the communes have transferred all of their powers in relation to communal roads, public transport and car parks and the communes with a population of 10,000 or more that are not part of these groupings;

2° Public establishments for inter-municipal cooperation with their own tax status with a population of less than 10,000 exercising all of the aforementioned powers and the communes with a population of less than 10,000 that are not part of these groupings.

II.-For the application of the second paragraph of Article L. 2334-25-1, the sums to be taken into account for 2018 are those calculated in accordance with 2° of I of this Article, as well as those calculated in accordance with 1° of the same I for municipalities or groupings whose population was greater than 10,000 inhabitants in 2017 and is less than this threshold in respect of the year of allocation.

III.-For the application of this section, the population to be taken into account is that defined in Article L. 2334-2.

Article R2334-10

I.-Le produit des amendes de police relatives à la circulation routière est partagé, proportionnellement au nombre des contraventions à la police de la circulation dressées sur leur territoire respectif au cours de l’année précédant celle au titre de laquelle est faite la répartition, entre :

1° Les établissements publics de coopération intercommunale à fiscalité propre comptant au moins 10 000 habitants, auxquels les communes ont transféré la totalité de leurs compétences en matière de voies communales, de transports en commun et de parcs de stationnement et les communes de 10 000 habitants et plus ne faisant pas partie de ces groupements ;

2° Les établissements publics de coopération intercommunale à fiscalité propre de moins de 10 000 habitants exerçant la totalité des compétences précitées et les communes de moins de 10 000 habitants ne faisant pas partie de ces groupements.

II.-Pour l’application du deuxième alinéa de l’article L. 2334-25-1, les sommes à prendre en compte pour l’année 2018 sont celles calculées conformément au 2° du I du présent article, ainsi que celles calculées conformément au 1° du même I pour les communes ou groupements dont la population était supérieure à 10 000 habitants en 2017 et est inférieure à ce seuil au titre de l’année de répartition.

III.-Pour l’application de la présente section, la population à prendre en compte est celle définie à l’article L. 2334-2.
