Article R2334-17 of the French General Code of Local Authorities

The establishment of undue payments on the representative accommodation allowance is made by the State services under the conditions laid down by a joint order of the ministers of national education and the interior and the minister responsible for the budget.

The overpayment is deducted from the housing allowance still to be paid. If the amount of the overpayment exceeds the amount of the allowance, the settlement will continue in the following month(s). Where the overpayment cannot be recovered using these procedures, the legal proceedings relating to its recovery shall be carried out, notwithstanding the provisions of article R. 2342-4, without the authorisation of the authorising officer. Recovery is carried out by the accounting officer of the Centre national de la fonction publique territoriale.

La constatation des indus sur l’indemnité représentative de logement est faite par les services de l’Etat dans les conditions prévues par un arrêté conjoint des ministres de l’éducation nationale et de l’intérieur et du ministre chargé du budget.

Le trop-perçu est imputé sur l’indemnité représentative de logement restant à verser. Lorsque son montant est supérieur à celui de l’indemnité, l’apurement se poursuit le ou les mois suivants. Lorsque le trop-perçu ne peut être récupéré selon ces modalités, les actes de poursuite relatifs à son recouvrement s’effectuent, par dérogation aux dispositions de l’article R. 2342-4, sans l’autorisation de l’ordonnateur. Le recouvrement est assuré par l’agent comptable du Centre national de la fonction publique territoriale.
