Article R2344-1 of the French Labour Code

The number of seats on the special negotiating body and the European works council set up in the absence of an agreement for each of the States mentioned in Article L. 2341-1 is set according to the following rules:

1° Up to 10% of the total workforce: 1 seat ;

2° From more than 10% to 20% of the total workforce: 2 seats;

3° Between 20% and 30% of the total workforce: 3 seats;

4° From more than 30% to 40% of the total workforce: 4 seats;

5° From more than 40% to 50% of the total workforce: 5 seats;

6° From more than 50% to 60% of the total workforce: 6 seats;

7° From more than 60% to 70% of the total workforce: 7 seats;

8° From more than 70% to 80% of the total workforce: 8 seats;

9° Between 80% and 90% of the total workforce: 9 seats;

10° More than 90% of the total workforce: 10 seats.

Le nombre de sièges au groupe spécial de négociation et au comité d’entreprise européen institué en l’absence d’accord pour chacun des Etats mentionnés à l’article L. 2341-1 est fixé selon les règles suivantes :

1° Jusqu’à 10 % de l’effectif total : 1 siège ;

2° De plus de 10 % à 20 % de l’effectif total : 2 sièges ;

3° De plus de 20 % à 30 % de l’effectif total : 3 sièges ;

4° De plus de 30 % à 40 % de l’effectif total : 4 sièges ;

5° De plus de 40 % à 50 % de l’effectif total : 5 sièges ;

6° De plus de 50 % à 60 % de l’effectif total : 6 sièges ;

7° De plus de 60 % à 70 % de l’effectif total : 7 sièges ;

8° De plus de 70 % à 80 % de l’effectif total : 8 sièges ;

9° De plus de 80 % à 90 % de l’effectif total : 9 sièges ;

10° Plus de 90 % de l’effectif total : 10 sièges.
