Article R2351-12 of the French Public procurement code

In the consultation documents, the purchaser may ask tenderers to indicate in their tender the proportion of the contract that they intend to subcontract to third parties, in particular to small and medium-sized enterprises within the meaning of Commission Recommendation 2003/361/EC of 6 May 2003 concerning the definition of micro, small and medium-sized enterprises or to craft businesses within the meaning of Article 19(I) of Law No. 96-603 of 5 July 1996, as amended, on the development and promotion of trade and craft businesses.

Dans les documents de la consultation, l’acheteur peut demander aux soumissionnaires d’indiquer dans leur offre la part du marché qu’ils ont l’intention de sous-contracter à des tiers, notamment à des petites et moyennes entreprises au sens de la recommandation 2003/361/ CE de la Commission du 6 mai 2003 concernant la définition des micro, petites et moyennes entreprises ou à des artisans au sens du I de l’article 19 de la loi n° 96-603 du 5 juillet 1996 modifiée relative au développement et à la promotion du commerce et de l’artisanat.
