Article R2371-6 of the French Public procurement code

The jury is made up of people who are independent of the candidates. When a particular professional qualification is required to take part in the procedure, at least one third of the members of the jury must hold this qualification or an equivalent qualification.
The members of the jury are appointed as follows:
1° In the case of central government departments, departments with national responsibilities and decentralised departments that are not placed under the authority of the Prefect, by the Minister to whom they report;
2° In the case of decentralised government departments placed under the authority of the Prefect, by the Prefect;
3° In the case of public government establishments, in accordance with the rules specific to each establishment.
In the case of a consortium, the composition of the jury is determined by the consortium agreement.

Le jury est composé de personnes indépendantes des candidats. Lorsqu’une qualification professionnelle particulière est exigée pour participer à la procédure, au moins un tiers des membres du jury doit posséder cette qualification ou une qualification équivalente.
Les membres du jury sont désignés selon les modalités suivantes :
1° En ce qui concerne les administrations centrales de l’Etat, les services à compétence nationale et les services déconcentrés qui ne sont pas placés sous l’autorité du préfet, par le ministre dont ils dépendent ;
2° En ce qui concerne les services déconcentrés de l’Etat placés sous l’autorité du préfet, par le préfet ;
3° En ce qui concerne les établissements publics de l’Etat, selon les règles propres à chaque établissement.
En cas de groupement de commandes, la composition du jury est fixée par la convention de groupement.
