Article R2372-12 of the French Public procurement code

When the commission can only be awarded to a specific service provider in accordance with the provisions of article R. 2322-5, the purchaser may negotiate the contract for the decoration of public buildings without prior advertising or competitive tendering.
In all other cases, the purchaser must advertise the programme of the artistic commission in such a way as to ensure that artists are adequately informed of the nature and value of the commission. The advertising notice specifies the number of artists who will be authorised to submit a project in response to the programme.

Lorsque la commande ne peut être confiée qu’à un prestataire déterminé en application des dispositions de l’article R. 2322-5, l’acheteur peut négocier sans publicité ni mise en concurrence préalables le marché de décoration des constructions publiques.
Dans les autres cas, il doit procéder à une publicité adaptée du programme de la commande artistique permettant une information suffisante des artistes en fonction de la nature et du montant de la commande. L’avis de publicité précise le nombre d’artistes qui sera autorisé à présenter un projet en réponse au programme.
