In the case of a contract with instalments, the contract may provide for the reimbursement of the advance payment to be deducted in advance from the sum due to the contractor in respect of the advance payment made for the next instalment, where the next instalment has been completed before the amount of the services performed under the previous instalment has reached 80% of the amount of the previous instalment, inclusive of all taxes.

Dans le cadre d’un marché à tranches, le marché peut prévoir que le remboursement de l’avance s’impute par précompte sur la somme due au titulaire au titre de l’avance versée pour la tranche suivante lorsque celle-ci a été affermie avant que le montant des prestations exécutées au titre de la tranche précédente n’ait atteint 80 % du montant de celle-ci toutes taxes comprises.
