Article R2391-27 of the French Public procurement code

In the event of the termination of a contract which has not provided for a retention of guarantee, where a period is granted to the contractor under the conditions laid down in article R. 2391-20-2 to repay to the purchaser 80% of the amount of any credit balance appearing in the purchaser’s favour, the purchaser may require the contractor to provide, at his discretion, either a first demand guarantee or a personal and joint surety.

En cas de résiliation d’un marché qui n’a pas prévu de retenue de garantie, lorsqu’un délai est accordé au titulaire dans les conditions prévues à l’article R. 2391-20-2 pour reverser à l’acheteur 80 % du montant de l’éventuel solde créditeur apparu au profit de celui-ci, l’acheteur peut exiger du titulaire que celui-ci fournisse, à sa convenance, soit une garantie à première demande soit une caution personnelle et solidaire.
