Article R2431-3 of the French Public procurement code

The project owner determines whether the work falls into one of the following categories:
1° New construction of a building;
2° Refurbishment of a building;
3° New construction of infrastructure;
4° Refurbishment of infrastructure.
The project owner may, where appropriate, divide the work into parts falling into one or other of these categories.

Le maître d’ouvrage détermine l’appartenance de l’ouvrage à l’une des catégories suivantes :
1° Opération de construction neuve de bâtiment ;
2° Opération de réhabilitation de bâtiment ;
3° Opération de construction neuve d’infrastructure ;
4° Opération de réhabilitation d’infrastructure.
Il peut, le cas échéant, scinder l’ouvrage en parties d’ouvrage relevant de l’une ou l’autre de ces catégories.
