Article R2431-34 of the French Public procurement code

The purpose of specific pre-project studies is :
1° To assess the consequences of the technical solution studied by the economic operator responsible for the works or the supplier of industrial products, ensuring that it is compatible with the constraints of the programme and that it is accompanied by all the necessary justifications and technical opinions;
2° To adopt the technical solution, if necessary to have it adapted, or to propose that it be rejected by the project owner;
3° Enabling the final remuneration of the project manager to be determined, taking into account the specific tasks entrusted to him;
4° Enabling the project owner to agree the conditions of performance of his public contract with the economic operator responsible for the works or the supplier of industrial products.

Les études spécifiques d’avant-projet ont pour objet :
1° D’apprécier les conséquences de la solution technique étudiée par l’opérateur économique chargé des travaux ou le fournisseur de produits industriels en s’assurant qu’elle est compatible avec les contraintes du programme et qu’elle est assortie de toutes les justifications et avis techniques nécessaires ;
2° De retenir la solution technique, le cas échéant de la faire adapter, ou d’en proposer le rejet au maître d’ouvrage ;
3° De permettre la fixation de la rémunération définitive du maître d’œuvre en tenant compte des éléments de missions spécifiques qui lui sont confiés ;
4° De permettre au maître d’ouvrage d’arrêter avec l’opérateur économique chargé des travaux ou le fournisseur de produits industriels les conditions d’exécution de son marché public.
