Article R2511-4 of the French General Code of Local Authorities

For the application of article L. 2511-20, the provisions of articles R. 2511-5 to R. 2511-16 apply to the following dwellings:

1° Dwellings owned or usufructuated by the municipality;

2° All dwellings, regardless of ownership, for which the municipality, by virtue of the regulations in force or agreements, has a right of allocation or proposal of allocation.

The provisions of article R. 2511-16 do not, however, apply to housing whose allocation is linked to an absolute necessity of service or to a utility of service, in particular for the operation of schools, as well as to the housing of teaching staff.

Pour l’application de l’article L. 2511-20, les dispositions des articles R. 2511-5 à R. 2511-16 s’appliquent aux logements suivants :

1° Les logements dont la commune est propriétaire ou usufruitière ;

2° L’ensemble des logements, quel qu’en soit le propriétaire, pour lesquels la commune, en vertu de la réglementation en vigueur ou de conventions, dispose d’un droit d’attribution ou de proposition d’attribution.

Les dispositions de l’article R. 2511-16 ne sont toutefois pas applicables aux logements dont l’affectation est liée à une nécessité absolue de service ou à une utilité de service, notamment pour le fonctionnement des établissements scolaires, ainsi qu’au logement des personnels enseignants.
