Article R290 of the French Code of Criminal Procedure

Article R. 62 is worded as follows:

“Art. R. 62.-In New Caledonia, French Polynesia and the Wallis and Futuna Islands, the criminal record instituted by the court of first instance is kept by the chief clerk of this court under the supervision of the public prosecutor and the public prosecutor. It receives the records concerning natural persons born within the jurisdiction of the court of first instance and the records of legal entities whose registered office is within the jurisdiction of this court.

“The automated national criminal records department receives records concerning natural persons born in France, natural persons born abroad, persons whose birth certificate cannot be found or whose identity is doubtful and legal entities whose registered office is located in France. “

L’article R. 62 est rédigé comme suit :

” Art. R. 62.-En Nouvelle-Calédonie, en Polynésie française et dans les îles Wallis et Futuna, le casier judiciaire institué près le tribunal de première instance est tenu par le greffier en chef de cette juridiction sous la surveillance du procureur de la République et du procureur général. Il reçoit les fiches concernant les personnes physiques nées dans le ressort du tribunal de première instance et les fiches des personnes morales dont le siège se situe dans le ressort de cette juridiction.

” Le service du casier judiciaire national automatisé reçoit les fiches concernant les personnes physiques nées en France, les personnes physiques nées à l’étranger, les personnes dont l’acte de naissance n’est pas retrouvé ou dont l’identité est douteuse et les personnes morales dont le siège se situe en France. “
