The commission provided for in Article 16 (2° and 4°) of the Code of Criminal Procedure, whose assent is required for the appointment of members of the national gendarmerie and civil servants from the national police corps d’encadrement et d’application to whom the status of judicial police officer is granted, is composed as follows:
1° The public prosecutor at the Court of Cassation or his delegate chosen by him from among the first advocates general and advocates general at the Court of Cassation, chairman;
2° Five active or honorary magistrates;
3° The director general of the national police or his representative;
4° The director general of the national gendarmerie or his representative;
5° The director, head of the general inspectorate of the national police or his representative;
6° The central director of recruitment and training for the national police or his representative;
7° The head of the general inspectorate of the national gendarmerie or his representative;
8° The commander of the national gendarmerie schools or his representative.
In the event of a tie, the chairman of the commission has the casting vote.
The members of the commission mentioned in 2° are appointed by joint order of the Minister of Justice and the Minister of the Interior for a term of four years, renewable once, and each have a deputy appointed under the same conditions. They may not serve on the Commission for more than eight years, regardless of whether they are a full member or an alternate member.
