The authority competent to impose administrative fines for breaches of Article L. 311-4-1 is the administrative authority designated by article R. 141-4 of the Consumer Code.
Prior to any decision, the administrative authority will send the accused person a copy of the official report recording the breaches, informing them in writing of the penalty envisaged against them, indicating that they may examine the documents in the file and be assisted by the counsel of their choice, and inviting them to present their written and, where appropriate, oral observations within a period of sixty days. After this period, the administrative authority may, by reasoned decision, impose the fine and issue the corresponding collection order.
The fine is recovered in the same way as debts other than taxes and property.
The limitation period for administrative action in respect of breaches of Article L. 311-4-1 is one year from the date of the breach, if during this period no action has been taken to investigate, establish or punish the breach.
