Article R311-12 of the French Intellectual Property Code

The authority competent to impose administrative fines for breaches of Article L. 311-4-1 is the administrative authority designated by article R. 141-4 of the Consumer Code.

Prior to any decision, the administrative authority will send the accused person a copy of the official report recording the breaches, informing them in writing of the penalty envisaged against them, indicating that they may examine the documents in the file and be assisted by the counsel of their choice, and inviting them to present their written and, where appropriate, oral observations within a period of sixty days. After this period, the administrative authority may, by reasoned decision, impose the fine and issue the corresponding collection order.

The fine is recovered in the same way as debts other than taxes and property.

The limitation period for administrative action in respect of breaches of Article L. 311-4-1 is one year from the date of the breach, if during this period no action has been taken to investigate, establish or punish the breach.

Article R311-12

L’autorité compétente pour prononcer les amendes administratives sanctionnant les manquements à l’article L. 311-4-1 est l’autorité administrative désignée par l’article R. 141-4 du code de la consommation.

Avant toute décision, l’autorité administrative transmet à la personne mise en cause une copie du procès-verbal constatant les manquements, l’informe par écrit de la sanction envisagée à son encontre, en lui indiquant qu’elle peut prendre connaissance des pièces du dossier et se faire assister par le conseil de son choix, et en l’invitant à présenter, dans le délai de soixante jours, ses observations écrites et, le cas échéant, orales. Passé ce délai, l’autorité administrative peut, par décision motivée, prononcer l’amende et émettre le titre de perception correspondant.

L’amende est recouvrée comme en matière de créances étrangères à l’impôt et au domaine.

Le délai de prescription de l’action administrative à l’égard des manquements à l’article L. 311-4-1 est d’une année révolue à compter des manquements, s’il n’a été fait pendant ce délai aucun acte tendant à leur recherche, à leur constatation ou à leur sanction.
