Article R311-6 of the French Code of civil enforcement procedures

Unless otherwise provided, any challenge or incidental claim shall be made by the filing at the Registry of pleadings signed by a lawyer.

The communication of pleadings and documents between lawyers is carried out in accordance with the conditions set out in article 766 of the Code of Civil Procedure. The summons is served on the debtor who has not constituted a lawyer.

If the dispute or incidental claim cannot be examined at the orientation hearing, the court clerk’s office summons the parties to a hearing by registered letter with acknowledgement of receipt within fifteen days of the filing of the dispute or claim.

The examination of challenges and incidental claims does not suspend the course of the proceedings.

A moins qu’il en soit disposé autrement, toute contestation ou demande incidente est formée par le dépôt au greffe de conclusions signées d’un avocat.


La communication des conclusions et des pièces entre avocats est faite dans les conditions prévues par l’article 766 du code de procédure civile. La communication des conclusions est faite par signification au débiteur qui n’a pas constitué avocat.


Lorsque la contestation ou la demande incidente ne peut être examinée à l’audience d’orientation, le greffe convoque les parties à une audience par lettre recommandée avec demande d’avis de réception dans un délai de quinze jours à compter du dépôt de la contestation ou de la demande.


L’examen des contestations et des demandes incidentes ne suspend pas le cours de la procédure.
