Article R3122-20 of the French Public Health Code

The Office may, in order to exercise the subrogatory action provided for in Article L. 3122-4, intervene even for the first time in an appeal before any administrative or judicial court. In this case, the Office will act as principal and may avail itself of all legal remedies.

L’office peut, pour exercer l’action subrogatoire prévue à l’article L. 3122-4, intervenir même pour la première fois en cause d’appel devant toute juridiction de l’ordre administratif ou judiciaire. Il intervient alors à titre principal et peut user de toutes les voies de recours ouvertes par la loi.
