Article R3123-3 of the French Public procurement code

If justified by the subject or conditions of the contract, the awarding authority may require information relating to the prior authorisation of candidates, pursuant to articles R. 2311-1 et seq. of the French Defence Code. It may grant those who are not authorised at the time of submitting their application an additional period to obtain this authorisation. It indicates this period in the notice of concession or, in the absence of such a notice, in another consultation document.

L’autorité concédante peut exiger, si l’objet ou les conditions du contrat le justifient, des renseignements relatifs à l’habilitation préalable des candidats, en application des articles R. 2311-1 et suivants du code de la défense. Elle peut accorder à ceux qui ne sont pas habilités au moment du dépôt de leur candidature un délai supplémentaire pour obtenir cette habilitation. Elle indique ce délai dans l’avis de concession ou, en l’absence d’un tel avis, dans un autre document de la consultation.
