Article R313-11 of the French Code governing the entry and residence of foreign nationals and the right of asylum

Notwithstanding article L. 231-1 of the Code des relations entre le public et l’administration, silence kept for more than one month by the mayor on the request for validation of the reception certificate or by the prefect on the administrative appeal mentioned in article R. 313-12 is deemed to be a rejection decision.

Par dérogation à l’article L. 231-1 du code des relations entre le public et l’administration, le silence gardé pendant plus d’un mois par le maire sur la demande de validation de l’attestation d’accueil ou par le préfet sur le recours administratif mentionné à l’article R. 313-12 vaut décision de rejet.
