Article R313-12 of the French Code governing the entry and residence of foreign nationals and the right of asylum

Any contentious appeal against a refusal to validate a reception certificate must be preceded, on pain of inadmissibility, by an administrative appeal to the territorially competent prefect, within two months of this refusal. Before making a decision, the prefect may have the certificate verified by the French Office for Immigration and Integration under the conditions laid down in article L. 313-5.

The prefect may also request that the certificate be validated by the Office Français de l’Immigration et de l’Intégration (French Office for Immigration and Integration) under the conditions laid down in article L. 313-5.

Tout recours contentieux dirigé contre un refus de validation d’une attestation d’accueil doit être précédé, à peine d’irrecevabilité, d’un recours administratif auprès du préfet territorialement compétent, dans un délai de deux mois à compter de ce refus. Avant de se prononcer le préfet peut faire procéder à une vérification par l’Office français de l’immigration et de l’intégration dans les conditions prévues à l’article L. 313-5.
