Article R313-21 of the French Consumer Code

Before making the offer referred to in Article L. 313-24, and unless it is clear that this is not the case, the creditor or credit intermediary shall ask the borrower whether the purpose of the credit transaction is to repay at least two previous debts, including a current loan. If the answer is in the affirmative, the borrower is provided with the information set out in articles R. 314-19 to R. 314-21.

Article R313-21

Avant la fourniture de l’offre mentionnée à l’article L. 313-24, et sauf s’il apparaît manifestement que tel n’est pas le cas, le prêteur ou l’intermédiaire de crédit demande à l’emprunteur si l’opération de crédit a pour objet le remboursement d’au moins deux créances antérieures dont un crédit en cours. En cas de réponse positive, l’emprunteur bénéficie de l’information prévue aux articles R. 314-19 à R. 314-21.
