Article R3133-3 of the French Public procurement code

An Order of the Minister for the Budget, appended to this Code, defines the technical procedures for submitting, transmitting and receiving invoices on the public invoicing portal in application of Article L. 3133-6. These procedures guarantee immediate and complete receipt of invoices and ensure reliable identification of the issuer, data integrity, security, confidentiality and traceability of exchanges.

Use of the public billing portal is exclusive of any other method of transmission. When an invoice is sent to it outside this portal, the recipient public entity may only reject it after informing the sender by any means of the obligation set out in Article L. 3133-1 and inviting him to comply by using this portal.

Article R3133-3

Un arrêté du ministre chargé du budget, annexé au présent code, définit les modalités techniques selon lesquelles le dépôt, la transmission et la réception des factures sont effectués sur le portail public de facturation en application de l’article L. 3133-6. Ces modalités garantissent la réception immédiate et intégrale des factures et assure la fiabilité de l’identification de l’émetteur, l’intégrité des données, la sécurité, la confidentialité et la traçabilité des échanges.

L’utilisation du portail public de facturation est exclusive de tout autre mode de transmission. Lorsqu’une facture lui est transmise en dehors de ce portail, la personne publique destinataire ne peut la rejeter qu’après avoir informé l’émetteur par tout moyen de l’obligation prévue à l’article L. 3133-1 et l’avoir invité à s’y conformer en utilisant ce portail.
