Article R3142-23 of the French Labour Code

The employer may refuse to grant the leave if he establishes that this refusal is justified by the particular needs of his company or its operations.

This refusal may only be made after consultation with the Social and Economic Committee.

If the employee renews his request after a period of four months has elapsed, he may not be refused a new postponement unless the number determined by article R. 3142-29 is exceeded.

Le bénéfice du congé peut être refusé par l’employeur s’il établit que ce refus est justifié par des nécessités particulières à son entreprise ou à l’exploitation de celle-ci.


Ce refus ne peut intervenir qu’après consultation du comité social et économique.


Si le salarié renouvelle sa demande après l’expiration d’un délai de quatre mois, un nouveau report ne peut lui être opposé sauf en cas de dépassement du nombre déterminé par l’article R. 3142-29.
