Article R321-17 of the French Intellectual Property Code

In the intervals between two general meetings, and at least two months before the forthcoming one, any member of the collective management organisation has the right to examine any document drawn up by this organisation or received by it concerning the current financial year, subject to respect for the secrets protected by law.

The member sends the organisation a written request specifying the documents to which he wishes to have access. Within ten days of receipt of the request, the organisation will communicate the documents or, if such communication is not materially possible, propose a date for the exercise of the right of access, which will then take place at the registered office or place of administrative management of the collective management organisation, under conditions defined by the Articles of Association. In exercising this right, the member may be assisted by any person of his choice.

Dans les intervalles entre deux assemblées générales, et au moins deux mois avant celle à venir, tout membre de l’organisme de gestion collective a le droit de prendre connaissance de tout document établi par cet organisme ou reçu par lui concernant l’exercice en cours, sous réserve du respect des secrets protégés par la loi.

Le membre adresse à l’organisme, une demande écrite mentionnant les documents auxquels il souhaite accéder. Dans un délai de dix jours à compter de la réception de la demande, l’organisme communique les documents ou, si cette communication n’est pas matériellement possible, propose une date pour l’exercice du droit d’accès qui s’effectue alors au siège social ou au lieu de la direction administrative de l’organisme de gestion collective, dans des conditions définies par les statuts. Dans l’exercice de ce droit, le membre peut se faire assister par toute personne de son choix.
