I. – The requests referred to in articles L. 327-6 and L. 327-13 shall be made by letter delivered against signature or any other means capable of establishing proof of the date of referral, including by electronic means.
They shall include:
1° If the person making the request is a natural person, their surname, first name, address and telephone number and, if they are subject to formalities for registration in the Trade and Companies Register or in the National Register of Companies as a business in the trades and crafts sector, their registration number ;
2° If the person making the request is a legal entity, its corporate form, its name or business name, its articles of association, the designation of its legal representative the telephone details of the natural person to be contacted, and, if it is a company subject to formalities for registration in the Trade and Companies Register or in the National Register of Companies as a company in the trades and crafts sector, its registration number and the address of its registered office ;
3° Where applicable, the name of its counsel or representative and the power of attorney given to the latter;
4° The subject and nature of the application with a statement of the claim or dispute and the documents on which the application is based ;
4° The name and address of the other parties implicated;
5° Any elements that may justify the steps that the author of the request has previously taken with the collective management organisation or the independent management organisation implicated.
The application and the file must be drawn up in French.
II. – If the request does not meet the requirements of I, the supervisory board or the ombudsman, as the case may be, sends a request for regularisation within a maximum period of one month to the author of the request. If the request is not rectified, it is declared inadmissible.
