Article R321-33 of the French Commercial code

I.-The advertisement provided for in the first paragraph of Article L. 321-11 shall specify at least the date and place of the planned sale, the name of the voluntary sales operator and the date of its declaration to the Conseil des Maisons de Vente, the name of the authorised person conducting the sale and, where applicable, the number of the declaration made pursuant to Article L. 321-24.

It must also state:

1° The seller’s status as a trader or craftsman when the new goods put up for sale are produced by him;

2° The new nature of the goods;

3° Where applicable, the status of the owner of the goods put up for sale when the latter is the organising voluntary public auction operator or his employee, manager or partner, as well as when he is an expert involved in organising the sale ;

4° The involvement of one or more experts in the organisation of the sale, specifying their specialities;

5° Mention of the limitation period provided for in Article L. 321-17.

II.-The voluntary sales operator shall bring the information mentioned in the fourth paragraph of Article L. 321-11 to the attention of the buyer in a visible manner by displaying a sign, the content and format of which comply with the model annexed to this code.

Article R321-33

I.-La publicité prévue au premier alinéa de l’article L. 321-11 précise au moins la date et le lieu de la vente projetée, la dénomination de l’opérateur de vente volontaires ainsi que la date de sa déclaration auprès du Conseil des maisons de vente, le nom de la personne habilitée qui dirige la vente et, le cas échéant, le numéro de la déclaration faite en application de l’article L. 321-24.

Elle doit également mentionner :

1° La qualité de commerçant ou d’artisan du vendeur lorsque les biens neufs mis en vente sont produits par lui ;

2° Le caractère neuf du bien ;

3° Le cas échéant, la qualité de propriétaire du bien mis en vente lorsque celui-ci est l’opérateur de ventes volontaires aux enchères publiques organisateur ou son salarié, dirigeant ou associé ainsi que lorsqu’il est un expert intervenant dans l’organisation de la vente ;

4° L’intervention d’un ou plusieurs experts dans l’organisation de la vente, en précisant leurs spécialités ;

5° La mention du délai de prescription prévu à l’article L. 321-17.

II.-L’opérateur de ventes volontaires porte à la connaissance de l’acheteur l’information mentionnée au quatrième alinéa de l’article L. 321-11 de manière visible par l’affichage d’un panneau dont le contenu et le format sont conformes au modèle annexé au présent code.
