The formal notice issued by the Chairman of the Conseil des Maisons de Vente or, after proceedings have been brought before the Enforcement Committee, by the Chairman of the Enforcement Committee pursuant to the first paragraph of III of article L. 321-23-2, specifies the breach(s) of which the trader is accused. It sets a deadline for the professional to remedy the breach(s).
The decision to issue a formal notice informs the professional that he is liable to disciplinary action if he repeats the breach or does not put an end to it within the given timeframe.
The decision is notified, by any means, to the professional concerned.
The professional and the Government Commissioner will be notified of the decision by any means giving a date certain. It shall indicate the court before which it may be contested and the time limit for appeal.
The President of the Conseil des Maisons de Vente or, after proceedings have been initiated before the Enforcement Committee, the President of the Enforcement Committee, will inform the Government Commissioner in the event of non-compliance with the formal notice.
