Article R321-5 of the French Code of civil enforcement procedures

The pursuing creditor shall serve a summons to pay on the principal debtor. The document shall state that the summons to pay valid as a seizure provided for in the following paragraph shall be issued to the third party purchaser.

The summons to pay valid as a seizure is served at the request of the pursuing creditor on the third party purchaser. It includes the information listed in article R. 321-3. However, the warning provided for in 4° is replaced by a summons to fulfil one of the obligations set out in article 2456 of the Civil Code within a period of one month and the reference to the debtor in 6°, 7°, 8°, 12° and 13° is to be understood as referring to the third party purchaser. The summons refers to the provisions of article 2454 of the Civil Code.

Le créancier poursuivant fait signifier un commandement de payer au débiteur principal. L’acte comporte la mention que le commandement de payer valant saisie prévu à l’alinéa ci-après est délivré au tiers acquéreur.

Le commandement de payer valant saisie est signifié à la diligence du créancier poursuivant au tiers acquéreur. Il comporte les mentions énumérées à l’article R. 321-3. Toutefois, l’avertissement prévu au 4° est remplacé par la sommation d’avoir à satisfaire à l’une des obligations énoncées à l’article 2456 du code civil dans un délai d’un mois et la mention du débiteur aux 6°, 7°, 8°, 12° et 13° s’entend de celle du tiers acquéreur. Le commandement rappelle les dispositions de l’article 2454 du code civil.
