Article R321-8 of the French Intellectual Property Code

I. – In order to grant authorisations for the multi-territorial exploitation of online rights in musical works, collective management organisations must comply with the following conditions:

1° Have the material and technical means to identify precisely, in whole or in part:

a) The musical works for which these exploitation authorisations are granted;

b) The rights and right holders corresponding to each musical work or part of a musical work, for each of the territories covered by these exploitation authorisations;

2° Make use of unique identifiers to identify each right holder and each musical work, taking into account, where they exist, voluntary sectoral standards and practices developed at international or European Union level ;

3° Use the necessary means to identify and correct inconsistencies in the data held by other collective management organisations, which grant authorisations for the multi-territorial exploitation of online rights in musical works, in coordination with these organisations.

II. – The processing of the data necessary for the management of authorisations for the multi-territorial exploitation of online rights in musical works must be transparent and allow the identification of the works for which these authorisations are granted and the monitoring of their use with a view to billing users, collecting and distributing the income due to right holders.

I. – Pour pouvoir octroyer des autorisations d’exploitation multiterritoriales de droits en ligne sur les œuvres musicales, les organismes de gestion collective doivent respecter les conditions suivantes :

1° Disposer des moyens matériels et techniques permettant d’identifier avec précision, en tout ou partie :

a) Les œuvres musicales pour lesquelles ces autorisations d’exploitation sont octroyées ;

b) Les droits et les titulaires de droits correspondant à chaque œuvre musicale ou partie d’œuvre musicale, pour chacun des territoires couverts par ces autorisations d’exploitation ;

2° Faire usage d’identifiants uniques pour identifier chaque titulaire de droits et chaque œuvre musicale, en tenant compte, lorsqu’elles existent, des normes et pratiques sectorielles volontaires élaborées à l’échelle internationale ou au niveau de l’Union européenne ;

3° Recourir aux moyens nécessaires pour identifier et corriger les incohérences dans les données détenues par d’autres organismes de gestion collective, qui octroient des autorisations d’exploitation multiterritoriales de droits en ligne sur des œuvres musicales, en coordination avec ces organismes.

II. – Le traitement des données nécessaires à la gestion des autorisations d’exploitation multiterritoriales de droits en ligne sur les œuvres musicales doit être transparent et permettre l’identification des œuvres pour lesquelles ces autorisations sont octroyées et le contrôle de leur utilisation en vue de la facturation aux utilisateurs, de la perception et de la répartition des revenus dus aux titulaires de droits.
