Article R3211-37 of the French Public Health Code

When the Freedoms and Detention Judge decides to refer the matter to himself pursuant to II of article L 3222-5-1 or the last paragraph of I of article L. 3211-12, he shall give the patient concerned by the seclusion or restraint measure, where applicable, his lawyer as soon as he is appointed, the person responsible for a legal protection measure relating to the person or, if he is a minor, his legal representatives and the doctor who took the measure, as well as the Public Prosecutor, the opportunity to make observations.

The clerk’s office notifies the institution of the automatic referral to the liberty and custody judge. Within a maximum of ten hours of this notification, the director of the institution shall send the registry, by any means, the information and documents mentioned in III of article R. 3211-34.

The last paragraph of article R. 3211-36 is applicable.

Lorsque le juge des libertés et de la détention décide de se saisir d’office en application du II de l’article L 3222-5-1 ou du dernier alinéa du I de l’article L. 3211-12, il met le patient concerné par la mesure d’isolement ou de contention, le cas échéant, son avocat dès sa désignation, la personne chargée à son égard d’une mesure de protection juridique relative à la personne ou, s’il est mineur, ses représentants légaux et le médecin ayant pris la mesure, ainsi que le ministère public, en mesure de produire des observations.

Le greffe avise l’établissement de la saisine d’office du juge des libertés et de la détention. Dans un délai maximal de dix heures à compter de cet avis, le directeur de l’établissement communique au greffe par tout moyen les informations et pièces mentionnées au III de l’article R. 3211-34.

Le dernier alinéa de l’article R. 3211-36 est applicable.
