Article R322-19 of the French Code of civil enforcement procedures

An appeal against a decision on a referral is lodged, investigated and judged according to the fixed day procedure without the appellant having to invoke a peril in his application.
Where the appeal is lodged against a judgment ordering the sale by auction, the court shall rule no later than one month before the date set for the auction. Failing this, the enforcement judge may, at the request of the pursuing creditor, postpone the date of the forced sale hearing. Where a stay of proceedings resulting from the application of article R. 121-22 prohibits the auction hearing from being held on the scheduled date and the judgement ordering the auction has been confirmed on appeal, the date of the auction is set on request by order of the enforcement judge. There is no right of appeal against decisions of the enforcement judge made pursuant to this paragraph.

L’appel contre le jugement d’orientation est formé, instruit et jugé selon la procédure à jour fixe sans que l’appelant ait à se prévaloir dans sa requête d’un péril.
Lorsque l’appel est formé contre un jugement ordonnant la vente par adjudication, la cour statue au plus tard un mois avant la date prévue pour l’adjudication. A défaut, le juge de l’exécution peut, à la demande du créancier poursuivant, reporter la date de l’audience de vente forcée. Lorsqu’une suspension des poursuites résultant de l’application de l’article R. 121-22 interdit de tenir l’audience d’adjudication à la date qui était prévue et que le jugement ordonnant l’adjudication a été confirmé en appel, la date de l’adjudication est fixée sur requête par ordonnance du juge de l’exécution. Les décisions du juge de l’exécution rendues en application du présent alinéa ne sont pas susceptibles d’appel.
