Article R322-4 of the French Intellectual Property Code

If, on the date of publication of the work, the author or his successor in title has not designated an approved collective management organisation, the organisation with the largest number of works managed, determined in accordance with the practices of the professions concerned, is deemed to be the assignee of the reprographic reproduction right.

The Minister responsible for culture designates each year the organisation or organisations that meet the condition defined in the previous paragraph.

Si, à la date de la publication de l’œuvre, l’auteur ou son ayant droit n’a pas désigné un organisme de gestion collective agréé, l’organisme réunissant le plus grand nombre d’œuvres gérées, déterminé conformément aux usages des professions concernées, est réputé cessionnaire du droit de reproduction par reprographie.

Le ministre chargé de la culture désigne chaque année le ou les organismes répondant à la condition définie à l’alinéa précédent.
