Article R3221-1 of the French General Code of Local Authorities

Any expenditure payable by the department or chargeable to its budget may only be incurred by the president of the departmental council.

Contracts, where applicable, are entered into by the president of the departmental council on behalf of the department, by deliberation of the departmental council.
