Collective agreements or, failing that, decrees by the Conseil d’Etat issued after consultation with the employers’ and employees’ organisations concerned, determine by profession or by professional category, nationally or regionally:
1° The methods of justification to be borne by the employer;
2° The categories of personnel who take part in the distribution of tips;
3° The methods of this distribution.
