Article R3314-3 of the French Labour Code

When the profit-sharing is distributed in proportion to salaries, the salaries to be taken into account for periods of leave, maternity leave, paternity leave, childcare leave, adoption leave and bereavement leave, as well as periods of suspension following an accident at work or occupational disease and periods of quarantine, are those that the beneficiary would have received had he been present.

Lorsque la répartition de l’intéressement est proportionnelle aux salaires, les salaires à prendre en compte au titre des périodes de congés, de maternité, de paternité et d’accueil de l’enfant d’adoption et de deuil ainsi que des périodes de suspension consécutives à un accident du travail ou à une maladie professionnelle et les périodes de mise en quarantaine sont ceux qu’aurait perçus le bénéficiaire s’il avait été présent.
