Article R333-1 of the French Code of civil enforcement procedures

In the absence of a record of agreement bearing the executory clause, the pursuing party shall refer the matter to the enforcement judge, forwarding to him the proposed distribution, a record of the difficulties encountered and any useful documents.
If the pursuing party fails to act promptly, any interested party may apply to the enforcement judge for judicial distribution. Where the distribution relates to sums from a property seizure, the application shall be made in accordance with article R. 311-6. Failing this, it shall be made by writ of summons.

Article R333-1

A défaut de procès-verbal d’accord revêtu de la formule exécutoire, la partie poursuivante saisit le juge de l’exécution en lui transmettant le projet de distribution, un procès-verbal exposant les difficultés rencontrées ainsi que tous documents utiles.
A défaut de diligence de la partie poursuivante, toute partie intéressée peut saisir le juge de l’exécution d’une requête aux fins de distribution judiciaire. Lorsque la distribution porte sur des sommes provenant d’une saisie immobilière, la demande est formée conformément à l’article R. 311-6. A défaut, elle est formée par assignation.
