Article R3332-29 of the French Labour Code

Pursuant to the second paragraph of article L. 3332-16, the following events may exceptionally result in the rights built up in favour of participants being unlocked before expiry of the term of the buy-back operation referred to in 2° of this article:
1° The employee’s disability, assessed within the meaning of 2° and 3° of article L. 341-4 of the French Social Security Code;
2° The employee’s retirement;
3° The employee’s death.
In the event of the employee’s death, it is the responsibility of those entitled under him to request the liquidation of his rights. In this case, the provisions of 4 of III of article 150-0-A of the General Tax Code cease to apply on expiry of the time limits set by article 641 of the same code.

Les faits en raison desquels, en application du deuxième alinéa de l’article L. 3332-16, les droits constitués au profit des participants peuvent être exceptionnellement débloqués avant l’expiration du terme de l’opération de rachat mentionné au 2° de cet article sont les suivants :
1° L’invalidité du salarié, appréciée au sens des 2° et 3° de l’article L. 341-4 du code de la sécurité sociale ;
2° La mise à la retraite du salarié ;
3° Le décès du salarié.
En cas de décès du salarié, il appartient à ses ayants droit de demander la liquidation de ses droits. Dans ce cas, les dispositions du 4 du III de l’article 150-0-A du code général des impôts cessent d’être applicables à l’expiration des délais fixés par l’article 641 du même code.
