The relay doctor monitors how the therapeutic injunction is being implemented. In the third and sixth months of the measure, he carries out a new medical examination of the person concerned, then, if the measure continues, new examinations every six months.
At the end of each examination, he informs the judicial authority of any changes in the person’s medical situation. This information is set out in a written report mentioning the type of care measure or medical supervision implemented, the regularity of the monitoring and, subject to medical confidentiality, any other information enabling the effectiveness of the person’s adherence to this measure to be assessed. The relay doctor may also conclude his report with a reasoned proposal to modify, extend or terminate the care or monitoring measure.
If, during the course of the therapeutic injunction measure, the person concerned wishes to change doctor or if this doctor no longer wishes to take on this role, the person concerned informs the relay doctor. The new doctor is chosen in accordance with articles R. 3413-13 and R. 3413-14.
