Article R342-12 of the French Code governing the entry and residence of foreign nationals and the right of asylum

When the public prosecutor intends to ask the first president of the court of appeal to declare the appeal suspensive, he must lodge an appeal within ten hours of the order being handed down. It shall notify the declaration of appeal, immediately and by any means, to the administrative authority, to the foreign national and, where applicable, to his lawyer, who shall acknowledge receipt thereof.
The notification shall state that observations in response to the request for a declaration of suspensive appeal may be sent by any means to the secretariat of the first president or his delegate within two hours.

Lorsque le ministère public entend solliciter du premier président de la cour d’appel qu’il déclare l’appel suspensif, il doit former appel dans le délai de dix heures à compter du prononcé de l’ordonnance. Il fait notifier la déclaration d’appel, immédiatement et par tout moyen, à l’autorité administrative, à l’étranger et, le cas échéant, à son avocat, qui en accusent réception.
La notification mentionne que des observations en réponse à la demande de déclaration d’appel suspensif peuvent être transmises par tout moyen au secrétariat du premier président ou de son délégué dans un délai de deux heures.
